Terms of Service

Welcome to Apartify. These Terms of Service ("Terms") govern your use of our website and mobile application (collectively, the "Platform") operated by an individual developer. By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

Apartify is a platform that connects property owners, landlords, and paying guest (PG) accommodation providers with tenants and flatmates seeking rental accommodations in India. The Platform enables users to:

• List properties for rent or as paying guest accommodations
• Search and discover properties based on location, budget, and preferences
• Connect directly with property listers through in-app chat and call features
• Apply to listings and communicate with potential flatmates

Important: Apartify operates solely as a platform intermediary. We do not own, manage, or guarantee any property listings. All transactions, including rental payments and brokerage arrangements, are conducted directly between users.

To use our Platform, you must create an account via email-based registration. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account
• Not create multiple accounts for fraudulent purposes

As a user of our Platform, you agree to:

• Use the Platform only for lawful purposes
• Provide accurate and truthful information in your listings and profile
• Respect the rights and privacy of other users
• Not engage in fraudulent, deceptive, or misleading practices
• Verify all property details independently before making any payments or commitments
• Not submit fake or spam inquiries
• Complete identity verification (Aadhaar OCR and face match) when requested
• Comply with all applicable laws and regulations

If you create property listings, you agree to:

• Only list properties that you have the right to rent or sublet
• Provide accurate descriptions, images, and pricing information
• Not create duplicate or spam listings
• Update or remove listings that are no longer available
• Respond to inquiries in a timely manner

We reserve the right to remove any listing that violates these Terms or our content policies at our sole discretion. Listings may be flagged, disabled, or removed for violations.

Apartify offers paid listing plans for users who wish to publish more than the free allowance of 3 listings. Payment for these plans is processed securely through Razorpay.

We offer identity verification through Aadhaar OCR (optical character recognition) and face matching technology. By submitting your verification documents:

• You consent to us processing your Aadhaar information and facial images for verification purposes
• Verification data is processed and stored securely
• We do not share your Aadhaar details with other users
• Verification status may be displayed on your profile

Platform Role: Apartify is purely a discovery and connection platform. We do not:

• Verify the authenticity of property ownership documents
• Guarantee the accuracy of listing information provided by users
• Mediate disputes between users
• Assume liability for any transactions between users
• Guarantee compatibility between flatmates

No Warranty:The Platform is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Apartify and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Platform
• Any unauthorized access to our servers or user data
• Any transactions or interactions between users
• Any conduct or content of any third party on the Platform

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Platform will immediately cease. We may retain certain information as required by law or for legitimate business purposes.

We may update these Terms from time to time. We will notify users of any material changes by posting the new Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.
